These End User Terms of Use (Terms)apply to your use of the Moment app and related services (the App)provided by Moment Events Pty Ltd (ABN 56 681 924 470) (Moment, we, us, our).
The App helps you discover,browse, and engage with events that have been set up on the Moment platform byevent organisers. By downloading, installing, accessing, creating an accounton, or otherwise using the App, you agree to these Terms. If you don’t agree,please don’t use the App.
These Terms apply to you as anend user of the App. If you are an event organiser using Moment to publishevents, a separate Terms of Service applies to your use of our platform and isavailable at momentevents.co/terms-of-service.
You can use the App if you meetthe minimum age requirements for your location:
• In Australia and most jurisdictions: you must be atleast 13 years old. If you are under 18, you must have your parent orguardian’s permission.
• In the European Union and United Kingdom: you must beat least 16 years old (or the digital age of consent in your country, if lower)to use the App without parental consent. If you are below this age, you musthave verifiable parental consent.
• In the United States: you must be at least 13 yearsold. If you are under 18, you must have your parent or guardian’s permission.
If you use the App on behalf ofan organisation, you confirm you have authority to bind that organisation tothese Terms.
Some features of the Apprequire you to create an account. If you create an account:
• you must provide accurate information and keep it up todate;
• you are responsible for keeping your login detailsconfidential and for any activity under your account;
• you must notify us promptly if you become aware of anyunauthorised access to your account;
• you must not share your account, create an accountusing someone else’s details, or create multiple accounts to evaderestrictions.
You can close your account atany time through the App or by contacting us.
We grant you a personal,limited, non-exclusive, non-transferable, revocable licence to use the App foryour own personal, non-commercial use, in accordance with these Terms.
Certain features of the Apprequire you to grant location permissions on your device. These featuresinclude viewing your live position on the event map and calculating yourdistance from event venues and facilities. Background location access, whichenables continuous positioning while the App is not actively on screen,requires separate consent through your device’s operating system. Movement pathtracking for heatmap analytics requires your separate in-app consent and can bedeclined without affecting your use of the map or any other App features. You must not:
• use the App for any unlawful, fraudulent, harmful, ormisleading purpose;
• copy, modify, reverse engineer, decompile, or createderivative works based on the App;
• attempt to gain unauthorised access to the App, otherusers’ accounts, or any related systems;
• use the App in a way that interferes with, disrupts, orplaces undue load on our systems or on other users’ experience;
• scrape, data-mine, or extract content from the Appother than for normal personal use;
• resell, rent, or otherwise commercially exploit accessto the App;
• harass, threaten, impersonate, or harm other users,event organisers, artists, or third parties;
• upload, post, or share content that is unlawful,defamatory, obscene, infringing, or otherwise objectionable; or
• use the App in any way that breaches any applicable lawor the policies of any app store through which you obtained the App.
Most of the event content yousee in the App — including artist lineups, schedules, maps, venue information,images, and event descriptions — is provided by event organisers, not by us.While we try to provide a good experience, we don’t guarantee the accuracy,completeness, or currency of event content, and event details may change.
If you submit content throughthe App (for example, reviews, comments, photos, or profile information), yougrant us a worldwide, non-exclusive, royalty-free licence to host, display, anduse that content within the App and for the purpose of operating and improvingthe Moment platform. This licence continues for as long as the content remainson the platform. If you delete your account, we will remove your submittedcontent within a reasonable period, subject to any legal obligation to retainit or any technical need to retain cached or backup copies for a limited time.You keep ownership of content you submit.
You are responsible for anycontent you submit. You must only submit content that you have the right toshare, and that complies with these Terms.
We may remove or restrictcontent that we reasonably believe breaches these Terms or is otherwiseinappropriate, and we may suspend or terminate accounts that breach theseTerms.
The App includes features thatuse your device’s location. These features are optional and require yourpermission:
• Live map position — with your permission, theApp can show your current location on the event map, helping you navigate theevent and find nearby venues and facilities. While you are actively using themap, your location is sampled continuously. When the map is not actively inuse, the App may check your location approximately every 60 seconds in thebackground, but this data is only sent to Moment if you are within the boundsof an event that is currently running.
• Distance calculations — the App can calculateand display your distance from event venues, stages, amenities, and otherpoints of interest.
• Movement tracking and heatmaps — with yourseparate in-app consent, the App may track your movement within the event overtime. This data is used solely to generate aggregated heatmap analytics forevent organisers, helping them understand general crowd flow and venue usage.Your individual movement path is never shared with event organisers or anythird party — only aggregated data that cannot identify you is shared. You candecline movement tracking without losing access to the map, distancecalculations, or any other App feature.
• Background location — some location features mayoperate while the App is in the background (not actively on screen). Backgroundlocation access requires your device’s operating system permission and can berevoked at any time through your device settings.
You can disable locationfeatures at any time through your device settings or in-app controls. Disablinglocation will not prevent you from using the App, but features that depend onyour location will be unavailable.

The App helps you engage withevents, but the events themselves are operated by third-party event organisers— not by Moment. We are not responsible for:
• the conduct, content, or decisions of event organisers;
• whether events take place, are cancelled, rescheduled,or changed;
• ticket availability, refunds, or admission to events;
• the safety, quality, or legality of events or venues;or
• any dispute between you and an event organiser or thirdparty.
If you have issues with anevent, you should contact the event organiser directly.
Our Privacy Policy explains howwe collect and handle personal information about you when you use the App,including detailed information about how we handle your location data, movementtracking, and analytics. By using the App, you acknowledge that we handle yourinformation in accordance with that Policy. You can find our Privacy Policy atmomentevents.co/privacy.
The App relies on third-partyservices to deliver its features. These include:
• Mapping services — Mapbox and/or OpenStreetMap,depending on the event’s configuration. When you view the event map, yourdevice connects directly to the mapping provider’s servers, which receive yourIP address and device information.
• Google Firebase — for analytics (FirebaseAnalytics), crash reporting (Firebase Crashlytics), and push notifications(Firebase Cloud Messaging).
• App stores — the Apple App Store and GooglePlay, through which the App is distributed.
Your use of these third-partyservices is governed by their own terms and privacy policies. We are notresponsible for the availability, performance, or conduct of those thirdparties.
We may update, change, ordiscontinue features of the App at any time. We may also update these Termsfrom time to time. The current version will always be available atmomentevents.co/end-user-terms. For material changes, we will give reasonablenotice, for example by in-App notice or, where you have an account, by email.
Your continued use of the Appafter a change takes effect means you accept the updated Terms.
We may suspend or terminateyour access to the App — immediately and without notice — if we reasonablybelieve you have breached these Terms, misused the App, or created a risk to usor other users. We may also suspend or discontinue the App or any of itsfeatures at any time.
You can stop using the App atany time. Closing your account does not affect any right or obligation that hasalready accrued.
To the maximum extent permittedby law, the App is provided “as is” and “as available”. We don’t warrant thatthe App will be uninterrupted, error-free, secure, or that information in itwill be accurate or current.
Nothing in these Termsexcludes, restricts, or modifies any consumer guarantee, right, or remedy underthe Australian Consumer Law, EU consumer protection directives, or any otherapplicable mandatory consumer protection law that cannot be excluded by agreement.Where we are permitted to limit our liability for a breach of a consumerguarantee in relation to the App, our liability is limited, at our option, tosupplying the App again or paying the cost of having it supplied again.
To the maximum extent permittedby law, we are not liable for any indirect, incidental, special, orconsequential loss or damage arising out of or in connection with your use ofthe App, including any loss of data, loss of profit, loss of opportunity, orloss related to events or event organisers.
Subject to the AustralianConsumer Law and any other applicable mandatory consumer protection laws, ourtotal liability to you for any claim arising out of or in connection with theseTerms or the App is limited to AUD $100. This cap does not apply to the extentit is prohibited by mandatory laws in your jurisdiction.
These Terms are governed by thelaws of Victoria, Australia. You and we submit to the exclusive jurisdiction ofthe courts of Victoria and the Commonwealth courts exercising jurisdiction inVictoria.
For users located outsideAustralia, we will first attempt to resolve any dispute informally throughgood-faith discussion before either party commences legal proceedings.
If any provision of these Termsis unenforceable, the rest will remain in effect. Our failure to enforce aright is not a waiver of that right. You may not transfer your rights underthese Terms; we may transfer ours in connection with a sale, merger, orrestructure.
